<p>Growing your family via surrogacy? First of all, big love — it’s a huge and beautiful step. But before you get caught up in the excitement (and maybe start picking baby names), it’s vital to know your legal options. We spoke to legal pro&nbsp;<a href="https://www.buckles-law.co.uk/staff/rebecca-varey/">Rebecca Varey</a>&nbsp;from&nbsp;<strong>Buckles Law</strong>&nbsp;to break it all down. Here’s what every intended parent needs to know, in plain English.</p>



<h3 class="wp-block-heading"><strong>Is surrogacy even legal in the UK?</strong></h3>



<p>Yes! It absolutely is in England and Wales. But don’t go printing off any contracts just yet. While the process is legal, there are some major legal hoops to jump through, and some definite don’ts.</p>



<p>The biggie? Legal parenthood doesn’t automatically transfer to the intended parents at birth.&nbsp;You’ll need to apply for a&nbsp;<strong>parental order</strong>&nbsp;after the baby is born to officially become the legal mum or dad (or both). And no, you can’t do that until your little one is at least&nbsp;<strong>six weeks old</strong>, with the surrogate’s consent.</p>

<p>Then there’s the law itself — slightly less glam, but crucial. For starters, surrogacy contracts in England and Wales? Totally unenforceable. And while you can’t technically pay someone to be your surrogate, you can cover reasonable expenses (travel, maternity wear, those extra tubs of Häagen-Dazs…). The key? Get clued up early. A proper chat with a legal expert will save you a whole lot of confusion (and stress) down the line.</p>



<h3 class="wp-block-heading"><strong>So what are the rules for getting a parental order?</strong></h3>

<p>To keep it simple, here’s what needs to be in place:</p>

<li>The surrogate must consent</li>



<li>The baby must be under&nbsp;<strong>six months old</strong></li>



<li>One intended parent must be&nbsp;<strong>genetically related</strong>&nbsp;to the baby</li>



<li>The child must live with you (in the UK)</li>



<li>You’re over 18</li>



<li>Any money paid beyond expenses must be OK’d by the court</li>



<li>The baby was conceived through assisted reproduction</li>
</ul>



<p>The court’s top priority?&nbsp;<strong>The child’s welfare</strong>. Every single time.</p>



<h3 class="wp-block-heading"><strong>Does it work differently for same-sex couples?</strong></h3>

<p>Not at all. Whether you’re a heterosexual or same-sex couple, or a single parent, the law applies equally. Once a parental order is granted, you’re officially the legal parent(s) — with full parental responsibility — and the birth certificate is re-issued in your name(s). Cue happy tears.</p>



<h3 class="wp-block-heading"><strong>Should we bother with a surrogacy agreement if it’s not legally binding?</strong></h3>

<p>Absolutely. Think of it like a detailed roadmap — it sets expectations and helps prevent awkward moments later. A solid surrogacy agreement can cover:</p>



<ul>
<li>Contact during pregnancy</li>



<li>Who attends scans and appointments</li>



<li>Birth plan (who cuts the cord?)</li>



<li>Post-birth arrangements</li>



<li>What “reasonable expenses” actually include</li>



<li>How to track costs</li>



<li>What happens if something unexpected crops up</li>
</ul>



<p>It’s not enforceable — but it&nbsp;<em>is</em>&nbsp;reassuring and helps keep everyone on the same page.</p>



<h3 class="wp-block-heading"><strong>What about going international? Is it riskier?</strong></h3>

<p>Short answer: yes, and complicated. Different countries have wildly different laws around surrogacy, and some don’t allow it at all. You’ll need to consider:</p>



<ul>
<li>Are you legally recognised as the child’s parents abroad?</li>



<li>What’s the legal status of the surrogate and her partner at birth?</li>



<li>Do you need documents translated or explained?</li>



<li>What will the baby’s nationality be?</li>



<li>How long will it take to bring them home to the UK?</li>



<li>Will immigration advice be needed?</li>
</ul>



<p>And most importantly, a UK&nbsp;<strong>parental order</strong>&nbsp;will still be needed even if you’re recognised as the legal parents overseas. The British courts do not care what the foreign birth certificate says.</p>



<h3 class="wp-block-heading"><strong>Can a surrogate change her mind?</strong></h3>



<p>In rare cases, yes. The surrogate must give&nbsp;<strong>written consent</strong>&nbsp;for the parental order, and technically she can change her mind. But don’t panic, most cases are resolved smoothly, especially when everyone’s been open, honest, and well-prepped from the start.</p>



<p>The court will always act in the&nbsp;<strong>best interests of the child</strong>, and a&nbsp;<strong>Cafcass officer</strong>&nbsp;(think legal social worker) will help assess this.</p>



<h3 class="wp-block-heading"><strong>Can I pay my surrogate anything?</strong></h3>



<p>Not in the way you might think. You’re allowed to cover&nbsp;<strong>reasonable expenses</strong>&nbsp;only — things like travel, supplements, time off work, and maternity clothing.</p>



<p>Best practice? Keep receipts and records. The court will want to see them when you apply for the parental order.</p>



<h3 class="wp-block-heading"><strong>Do I really need a solicitor, or can I DIY this?</strong></h3>



<p>You&nbsp;<em>can</em>&nbsp;DIY… but should you? Probably not. A solicitor won’t just dot the i’s — they’ll guide you through every emotional and legal twist, flag potential pitfalls, and give you peace of mind. Legal support from the start is worth its weight in gold (and saves a whole lot of stress).</p>



<h3 class="wp-block-heading" id="h-what-about-single-parents-or-lgbtq-families"><strong>What about single parents or LGBTQ+ families?</strong></h3>

<p>Good news: since 2019,&nbsp;<strong>single parents</strong>&nbsp;can apply for a parental order. LGBTQ+ couples are fully supported under the same laws as heterosexual couples. The process and requirements are exactly the same — no extra hoops, just the same legal love.</p>



<h3 class="wp-block-heading"><strong>Your one golden nugget of advice?</strong></h3>



<p><strong>Get legal advice early</strong>&nbsp;— and keep clear, detailed records of everything: conversations, agreements, expenses, the lot. It’s the best way to protect yourself and your growing family.</p>
